That's a loaded question. I say yes, because parties can agree not to agree, and with no mutual assent, there is no agreement. You can assend to agree, I can assend not to agree, and yet there exists an agreement. You can agree, and agreement to agree is not enforceable. Either you have an agreement or you don't, to the positive or negative, but it must be current - not for a future date. Further, an agreement is completely different than a contract - a contract requires consideration, undertaking or a promise with some consideration. Absent that, there is just an agreement, but not a contract.
